These Terms and Conditions apply to purchases made through the Blakmint online store.

Please read them before placing an order. By placing an order with us, you agree to these Terms together with our:

  • Shipping and Delivery Policy
  • Returns and Refund Policy
  • Privacy Policy
  • Cookie Policy
  • applicable Product Instructions for Use

Nothing in these Terms excludes or restricts your statutory rights under UK consumer law.

In these Terms, “Blakmint”, “we”, “us” and “our” mean Blakmint Ltd.

“You” and “your” mean the person placing an order through our website.

2. Who Can Place an Order

You must be at least 18 years old and legally capable of entering into a binding contract.

Our products are primarily offered to consumers purchasing for personal use.

Please contact us before purchasing products for commercial resale, professional distribution or export.

We currently accept orders for delivery within Great Britain only, meaning England, Scotland and Wales.

3. Our Products

Blakmint sells products intended for the cleaning, handling, maintenance and storage of removable oral appliances, including:

  • Liquid Retainer Cleaner
  • Retainer Cleaning Brush
  • Retainer Removal Hook
  • Aligner Chewies
  • Retainer Case
  • kits and bundles containing these products

Except for the Blakmint Retainer Case, Blakmint products identified and supplied as medical devices are UK Class I medical devices and are placed on the Great Britain market in accordance with the applicable medical-device requirements.

The Blakmint Retainer Case is not a medical device. It is supplied as a consumer accessory for storing and, where applicable, cleaning removable oral appliances.

The inclusion of the Retainer Case within a kit or bundle containing medical devices does not make the Retainer Case itself a medical device.

Products must be used only for their stated purpose and in accordance with:

  • the product label;
  • packaging information;
  • warnings;
  • Instructions for Use;
  • directions provided by a dentist or orthodontist; and
  • instructions supplied by the manufacturer of your oral appliance.

Blakmint products do not replace professional dental advice, diagnosis, treatment, appliance fitting or appliance inspection.

4. Product Information and Images

We take reasonable care to ensure product descriptions, photographs, measurements, specifications and prices are accurate.

However:

  • colours may vary slightly depending on screen settings;
  • packaging may be updated from time to time;
  • photographs may not show products at their exact physical scale;
  • minor differences may occur between manufacturing batches; and
  • non-material packaging or presentation changes may be made.

Any material change affecting intended use, performance or safety will be reflected in the relevant product information or Instructions for Use where required.

5. Product Compatibility

Removable oral appliances vary in material, design, construction, age and condition.

Suitability may depend on factors including:

  • appliance material;
  • appliance manufacturer's instructions;
  • age and condition;
  • previous damage;
  • normal wear;
  • heat exposure;
  • grinding or clenching;
  • cleaning methods; and
  • advice from your dentist or orthodontist.

You should ensure that the Blakmint product and cleaning method are suitable for your particular appliance.

If compatibility is uncertain, consult your dentist, orthodontist or appliance manufacturer before use.

6. Inspecting Your Oral Appliance

You should inspect your oral appliance before and after cleaning.

Do not continue using a Blakmint cleaning product on an appliance showing significant structural damage or deterioration, including:

  • cracks;
  • splits;
  • holes;
  • significant warping;
  • brittleness;
  • crumbling;
  • unusual softening;
  • significant thinning;
  • weakened areas;
  • sharp or broken edges; or
  • visible material breakdown.

Cloudiness, staining, whitening or discolouration alone does not necessarily mean that an appliance is structurally damaged.

However, if these changes occur together with cracking, brittleness, distortion, softening or other deterioration, discontinue use and seek professional advice.

Do not continue cleaning or wearing an appliance which a dental professional has advised should be repaired or replaced.

7. Appliance Age and Normal Wear

Removable oral appliances naturally wear and deteriorate over time.

Their useful life varies according to factors including:

  • material;
  • design;
  • construction;
  • frequency of wear;
  • oral habits;
  • grinding or clenching;
  • storage;
  • heat exposure;
  • cleaning methods; and
  • the appliance provider's recommendations.

Older, heavily used, previously damaged or poorly maintained appliances may be more vulnerable to scratching, cracking, warping or other deterioration during ordinary use, handling or cleaning.

Normal wear, deterioration or a pre-existing appliance defect does not by itself establish that a Blakmint product was faulty.

8. Following the Instructions for Use

You are responsible for reading and following the Instructions for Use supplied with or made available for the relevant product.

This includes:

  • preparing the correct dilution;
  • accurately measuring the cleaner;
  • using an appropriate water temperature;
  • observing recommended soaking times;
  • brushing gently where instructed;
  • avoiding abrasive materials;
  • rinsing the appliance thoroughly;
  • cleaning and drying reusable containers as directed;
  • replacing prepared cleaning solution as directed;
  • inspecting the appliance;
  • confirming ultrasonic compatibility; and
  • following professional and appliance-manufacturer advice.

Instructions for Use should be retained or remain accessible for future reference.

9. Use of Blakmint Liquid Retainer Cleaner

Blakmint Liquid Retainer Cleaner must be prepared and used according to its Instructions for Use.

You must not:

  • use the concentrated product undiluted;
  • exceed the stated concentration;
  • deliberately use substantially more product than directed;
  • use hot or boiling water;
  • heat the prepared solution;
  • microwave the product or prepared solution;
  • mix it with retainer cleaning tablets;
  • mix it with bleach;
  • mix it with household cleaners;
  • mix it with mouthwash;
  • mix it with other chemical cleaning products;
  • use it as mouthwash;
  • swallow it; or
  • place the concentrated cleaner directly into the mouth.

The appliance must be thoroughly rinsed with clean water before being placed back into the mouth.

10. Soaking Times

Cleaning should be carried out for the period stated in the Instructions for Use.

Where overnight soaking is permitted, this should only be carried out:

  • at the correct dilution;
  • with an appropriate water temperature;
  • in a suitable closed container;
  • on an appliance compatible with extended soaking;
  • where the appliance manufacturer or dental professional has not advised against it; and
  • for no longer than the period stated in the Instructions for Use.

Do not leave an appliance soaking indefinitely.

If you notice softening, significant warping, cracking or another concerning material change, discontinue use and seek professional advice.

11. Brushing and Over-Scrubbing

Where brushing is recommended, use a suitable brush and light pressure.

Do not:

  • scrub excessively;
  • repeatedly scrape the same area;
  • use unreasonable force;
  • bend or twist the appliance while cleaning it;
  • use abrasive toothpaste;
  • use abrasive powders;
  • use metal cleaning tools;
  • use sharp implements;
  • use scourers; or
  • continue brushing if the appliance begins to flex, split, scratch significantly or change shape.

Excessive force and abrasive cleaning methods may scratch or damage oral appliances.

Damage caused solely by unreasonable force, abrasive materials or failure to follow cleaning instructions does not establish that a Blakmint product was defective.

This does not affect your rights where a Blakmint product itself was faulty, unsafe or not as described.

12. Reusing Prepared Cleaning Solution

Prepared Blakmint cleaning solution may only be reused for the period and under the conditions stated in the Instructions for Use.

Where reuse is permitted, you should:

  • keep the solution in a clean and suitable container;
  • close the container properly;
  • replace the solution within the stated period;
  • replace it sooner if visibly contaminated;
  • clean the container as directed; and
  • avoid continually topping up old cleaning solution.

Prepared cleaning solution must not be reused beyond Day 6.

Blakmint is not responsible for contamination or damage caused solely by keeping or reusing solution contrary to the Instructions for Use.

13. Ultrasonic Cleaning Devices

Blakmint Liquid Retainer Cleaner may be used only with a compatible ultrasonic cleaning device and in accordance with the Instructions for Use.

Where the Blakmint cleaner is used in an ultrasonic machine, the user is responsible for ensuring that the machine:

  • is suitable for removable oral appliances;
  • is in safe working condition;
  • is used in accordance with its manufacturer's instructions;
  • permits the use of diluted liquid cleaning solution; and
  • is operated without exposing the appliance to inappropriate heat.

Do not use Blakmint Liquid Retainer Cleaner with:

  • hot or boiling water;
  • a heated cleaning cycle where this could damage the oral appliance;
  • a machine that causes the solution to become excessively hot;
  • a damaged or modified machine;
  • an unsuitable machine;
  • repeated or excessive ultrasonic cycles; or
  • a device used contrary to its manufacturer's instructions.

Heat can soften, warp or damage some thermoplastic retainers and aligners.

If the solution becomes unexpectedly hot during ultrasonic use, stop using the machine and remove the appliance.

14. Third-Party Ultrasonic Devices

Blakmint does not manufacture or control third-party ultrasonic cleaners.

The appearance or mention of an ultrasonic cleaner on the Blakmint website or in marketing material does not mean that Blakmint approves every:

  • manufacturer;
  • model;
  • seller;
  • temperature setting;
  • cleaning cycle; or
  • operating method.

We do not guarantee compatibility with every ultrasonic device or every oral-appliance material.

Damage caused solely by heat, a defective third-party machine, an incompatible device, unauthorised modification or use contrary to a third-party manufacturer's instructions does not establish that Blakmint Liquid Retainer Cleaner was defective.

This does not exclude liability where the Blakmint product itself was defective, unsafe or supplied with inadequate instructions.

15. Customer Misuse

Misuse may include:

  • failure to follow Instructions for Use;
  • incorrect dilution;
  • use of undiluted cleaner;
  • use of hot or boiling water;
  • heating the cleaner or prepared solution;
  • soaking beyond the permitted period;
  • excessive or abrasive scrubbing;
  • using abrasive toothpaste or cleaning products;
  • bending or twisting the appliance;
  • combining Blakmint cleaner with other chemicals;
  • failing to rinse the appliance;
  • using the product on a significantly damaged appliance;
  • using an unsuitable ultrasonic cleaner;
  • inappropriate use of an ultrasonic heating function;
  • repeated or excessive ultrasonic cycles;
  • storing reusable solution contrary to instructions;
  • reusing visibly contaminated solution;
  • continuing use after concerning changes become apparent; or
  • using the product for a purpose other than its stated intended use.

Damage caused solely by misuse does not mean that the Blakmint product was faulty.

16. Investigating Reported Appliance Damage

If you report damage to an oral appliance, we may reasonably request information necessary to investigate.

This may include:

  • photographs or video;
  • photographs from before and after cleaning, if available;
  • appliance type;
  • appliance material;
  • approximate appliance age;
  • details of previous wear or damage;
  • cleaner dilution;
  • soaking duration;
  • water temperature;
  • brushing method;
  • brush type;
  • whether an ultrasonic cleaner was used;
  • ultrasonic cleaner make and model;
  • whether the machine included a heating function;
  • number and duration of cycles;
  • Blakmint batch or lot information; and
  • whether the Instructions for Use were followed.

You should retain the relevant Blakmint product, packaging and affected appliance while a complaint is being investigated where reasonably possible.

Requesting this information does not remove any statutory remedy to which you may be entitled.

17. Medical-Device Safety Incidents

If you believe a Blakmint product supplied as a medical device may be unsafe or may have contributed to an adverse incident, stop using it and contact us at:

Please provide, where possible:

  • order number;
  • product name;
  • batch or lot number;
  • description of the incident;
  • photographs or videos;
  • details of how the product was used; and
  • details of relevant medical or dental advice.

Seek urgent medical or dental assistance where necessary.

Where a complaint concerns a Blakmint product classified as a medical device, Blakmint may be required to record, investigate or report relevant safety information in accordance with applicable medical-device requirements.

The Blakmint Retainer Case is not a medical device. Complaints relating solely to the Retainer Case will normally be handled under our general product-safety and consumer-law procedures.

18. Product Availability

All products are subject to availability.

Adding a product to your basket does not reserve it.

If a product becomes unavailable after you place an order, we may:

  • offer an alternative with your agreement;
  • provide a revised estimated dispatch date; or
  • cancel the affected item and refund the amount paid.

We will not substitute a materially different product without your agreement.

19. How the Contract Is Formed

Products displayed on our website are an invitation for you to place an order.

When you place an order, you make an offer to purchase the products shown in your order.

You will normally receive an order-confirmation email acknowledging receipt of your order.

Unless we tell you otherwise, the contract between us is formed when we send confirmation that your order has been dispatched.

We may decline or cancel an order before dispatch where:

  • a product is unavailable;
  • payment cannot be authorised;
  • an obvious pricing or description error has occurred;
  • the delivery address is outside the area we serve;
  • fraud or unauthorised payment is reasonably suspected;
  • purchase restrictions have been exceeded; or
  • we are legally unable to supply the product.

If payment has already been taken for a cancelled order, the relevant amount will be refunded.

20. Order Information

You are responsible for checking the information you enter when placing an order, including:

  • name;
  • email address;
  • delivery address;
  • billing details;
  • products selected; and
  • quantities.

Contact us as soon as possible if you notice an error.

We cannot guarantee that an order can be changed after processing or dispatch has begun.

21. Prices and VAT

Prices are displayed in pounds sterling.

Prices include VAT where VAT is applicable.

Delivery charges, where applicable, will be shown before you place your order.

We may change prices at any time, but a later price change will not affect an order for which a contract has already been formed.

22. Pricing and Technical Errors

We take reasonable care to ensure prices and product information are correct.

If there is an obvious and unmistakable pricing, discount or technical error, we may contact you before dispatch and ask whether you wish to proceed on the corrected basis.

We may cancel and refund an order where:

  • a displayed price was clearly incorrect;
  • a discount resulted from an obvious technical error;
  • materially incorrect product information was displayed; or
  • it would be unreasonable to expect us to honour an obvious mistake.

This does not permit us to alter an agreed price simply because the transaction later becomes commercially disadvantageous to us.

23. Payment

Payment must be authorised before dispatch.

Payments are processed through Shopify and payment providers available through our checkout.

We do not normally store your complete payment-card details ourselves.

Available payment methods may vary.

24. Promotions and Discount Codes

Promotions may be subject to additional conditions displayed with the offer.

Unless otherwise stated:

  • only one promotional code may be used per order;
  • promotional codes have no cash value;
  • codes may apply only to selected products;
  • codes may have an expiry date;
  • codes cannot normally be applied after an order is submitted; and
  • an offer resulting from an obvious error may be corrected or withdrawn.

Sale and discounted goods retain the same statutory protections as full-price goods.

25. Shipping and Dispatch

We currently deliver within Great Britain only: England, Scotland and Wales.

We aim to dispatch orders within 2 working days after successful payment.

“Working day” means Monday to Friday excluding applicable public and bank holidays.

Most orders are sent using Royal Mail Tracked 48.

A Retainer Cleaning Brush purchased on its own will normally be sent using Royal Mail 2nd Class.

Retainer Removal Hook & Chewies purchased on their own will normally be sent using Royal Mail 2nd Class.

Where a Brush or Hook & Chewies are purchased with another product, as part of a kit, or as part of a bundle, the complete order will normally be sent using Royal Mail Tracked 48.

Delivery times are estimates unless we expressly offer a guaranteed service.

26. Delivery Risk

Goods remain at Blakmint's risk until they come into your physical possession or into the physical possession of another person nominated by you to receive them.

If a parcel is genuinely missing, contact Blakmint and we will investigate with Royal Mail where appropriate.

27. Online Cancellation Rights

For eligible products purchased online, consumers will generally have a legal right to cancel within the applicable statutory cancellation period.

Our Returns and Refund Policy explains:

  • how to cancel;
  • return deadlines;
  • hygiene-sensitive products;
  • return costs;
  • faulty goods; and
  • refund processing.

Nothing in these Terms reduces statutory cancellation rights where they apply.

28. Hygiene-Sealed Products

Certain Blakmint products are supplied sealed for health-protection or hygiene reasons.

These may include:

  • Retainer Cleaning Brushes;
  • Retainer Removal Hooks;
  • Aligner Chewies;
  • mouth-contact accessories;
  • Retainer Cases intended to hold oral appliances;
  • Liquid Retainer Cleaner supplied with a tamper-evident seal; and
  • kits containing hygiene-sensitive products.

Where a product:

  • was supplied sealed;
  • is unsuitable for return for health-protection or hygiene reasons; and
  • has been unsealed after delivery,

the statutory change-of-mind cancellation right may no longer apply to that product.

Please inspect products and packaging before breaking a hygiene or tamper-evident seal if you are unsure whether you wish to keep them.

This hygiene exception does not remove your statutory rights if a product is:

  • faulty;
  • unsafe;
  • damaged;
  • incorrectly supplied;
  • not as described;
  • not of satisfactory quality; or
  • otherwise fails to conform to the contract.

29. Faulty Goods and Statutory Rights

Goods supplied by Blakmint must comply with applicable consumer-law requirements.

This includes requirements concerning satisfactory quality, fitness for purpose where applicable and conformity with their description.

Where goods do not conform to the contract, you may have statutory rights including, depending on the circumstances:

  • rejection and refund;
  • repair;
  • replacement;
  • price reduction; or
  • final rejection.

Opening a sealed product where reasonably necessary to discover or demonstrate a fault does not automatically remove your statutory rights.

Nothing in these Terms limits rights which cannot legally be excluded.

30. Returns and Refunds

Eligible change-of-mind returns must comply with our Returns and Refund Policy.

Where required by law, an eligible cancellation refund will include:

  • the price paid for the returned goods; and
  • the cost of our least expensive standard outbound delivery option.

Customers are normally responsible for the direct cost of an eligible change-of-mind return.

Where goods are faulty, damaged, incorrectly supplied or not as described, we will cover reasonable return costs where required by law.

Where permitted, we may wait to issue a change-of-mind refund until the goods are returned or you provide evidence that they have been sent back.

31. Our Responsibility to Consumers

We are responsible for loss or damage which is a foreseeable consequence of:

  • our breach of these Terms; or
  • our failure to exercise reasonable care and skill.

Nothing in these Terms excludes or restricts liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • defective products where liability cannot legally be excluded;
  • breach of statutory consumer rights;
  • liability arising under applicable product-safety or medical-device law where it cannot be excluded; or
  • any other liability which cannot legally be excluded or restricted.

32. Matters for Which We Are Not Responsible

Subject to section 31, we are not responsible for appliance loss or damage caused solely by:

  • failure to follow Instructions for Use;
  • incorrect dilution;
  • use of undiluted cleaner;
  • excessive soaking;
  • use of inappropriate water temperatures;
  • heating the cleaning solution;
  • aggressive or abrasive brushing;
  • use of abrasive toothpaste or materials;
  • bending, twisting or dropping an appliance;
  • ordinary appliance wear;
  • pre-existing defects;
  • continuing to use a visibly damaged appliance;
  • using incompatible cleaning products;
  • use of an unsuitable ultrasonic machine;
  • inappropriate heat from an ultrasonic machine;
  • use of a damaged or modified third-party device;
  • failure to follow third-party equipment instructions;
  • repeated or excessive ultrasonic cycles;
  • incorrect storage or reuse of prepared solution; or
  • use outside the stated intended purpose.

This section does not apply where loss or damage was caused by:

  • a defective Blakmint product;
  • inadequate Blakmint instructions;
  • our negligence;
  • breach of your statutory rights; or
  • another matter for which liability cannot legally be excluded.

33. Business Use

Our consumer products are supplied primarily for private and domestic use.

If you use a product wholly for a commercial or business purpose without prior written agreement, we will not normally be responsible for:

  • loss of profit;
  • loss of revenue;
  • loss of business;
  • business interruption; or
  • loss of commercial opportunity,

except where such liability cannot legally be excluded.

This does not affect rights held by a consumer purchasing wholly or mainly for personal use.

34. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control.

Examples may include:

  • severe weather;
  • fire;
  • flood;
  • postal disruption;
  • industrial action;
  • transport interruption;
  • significant supply-chain disruption;
  • government action;
  • interruption to utilities or communications; or
  • other circumstances we could not reasonably prevent.

We will take reasonable steps to minimise the effect of such events.

This does not remove statutory cancellation or refund rights.

35. Website Availability

We aim to keep our website available and secure but cannot guarantee uninterrupted availability.

Access may occasionally be suspended or restricted for:

  • maintenance;
  • technical updates;
  • security;
  • fraud prevention; or
  • circumstances outside our reasonable control.

This will not affect contracts already formed.

36. Intellectual Property

Unless otherwise stated, intellectual property contained on or associated with the website is owned by or licensed to Blakmint Ltd.

This may include:

  • the Blakmint name;
  • Blakmint logo;
  • product names;
  • product designs;
  • packaging designs;
  • photographs;
  • graphics;
  • written content;
  • videos;
  • downloadable materials; and
  • website content.

You may use website content only for personal, non-commercial shopping purposes.

You must not reproduce, modify, publish, distribute, sell or commercially exploit protected content without permission.

37. Reviews and Customer Content

If customers are able to submit reviews, photographs, videos or other content, that content must not be:

  • knowingly false or misleading;
  • defamatory;
  • abusive;
  • unlawful;
  • discriminatory;
  • obscene;
  • infringing of intellectual-property rights;
  • infringing another person's privacy;
  • promotional spam; or
  • malicious.

You must have permission to upload content containing another identifiable person.

We may moderate or remove content which breaches these conditions.

You retain ownership of content you submit but grant Blakmint a non-exclusive, royalty-free licence to display and use that content in connection with our website, products and marketing, subject to applicable privacy law and any additional permission requirements.

Blakmint does not knowingly publish, purchase or commission fake or misleading consumer reviews.

We may use reasonable and proportionate measures to help establish whether reviews relate to genuine customer experiences.

38. Acceptable Website Use

You must not:

  • use the website unlawfully;
  • place fraudulent orders;
  • provide false payment or delivery information;
  • attempt unauthorised access to systems;
  • interfere with website security;
  • introduce malware;
  • impersonate another person;
  • overload or disrupt the website; or
  • infringe the rights of Blakmint or another person.

We may restrict access or cancel orders where reasonably necessary to prevent fraud or unlawful activity.

39. Personal Information

We process personal information in accordance with our Privacy Policy and Cookie Policy.

Information may be processed for purposes including:

  • order fulfilment;
  • payment processing;
  • Royal Mail delivery;
  • customer service;
  • fraud prevention;
  • regulatory compliance;
  • product-safety monitoring;
  • medical-device post-market surveillance;
  • recalls or corrective actions; and
  • marketing where legally permitted.

Medical-device regulatory processing applies only where relevant to products which are legally classified as medical devices.

The Blakmint Retainer Case is not a medical device.

Payment information is primarily handled by our payment providers rather than being stored directly by Blakmint.

40. Complaints

Complaints should be sent to:

Please provide:

  • your name;
  • order number;
  • description of the issue; and
  • photographs or other supporting evidence where relevant.

We will attempt to resolve complaints fairly.

Where appropriate, unresolved consumer disputes may be referred to an appropriate alternative dispute-resolution process if agreed or legally required.

41. Governing Law and Courts

These Terms are governed by the laws of England and Wales.

Consumers resident in England or Wales may generally bring proceedings in the courts of England and Wales.

Consumers resident in Scotland may generally bring proceedings in the Scottish courts.

Nothing in these Terms removes any mandatory consumer protection available to you.

42. Changes to These Terms

We may update these Terms to reflect changes in:

  • law;
  • regulation;
  • products;
  • safety information;
  • delivery services;
  • payment systems;
  • website functionality; or
  • our business operations.

The version applicable when your contract was formed will normally apply to that order.

A later change will not retrospectively remove rights applying to an existing order.

43. Severability

If a court or competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply.

44. Delay in Enforcing Rights

If either party delays enforcing a right, that does not mean the right has been waived.

45. Transferring the Contract

We may transfer our rights or obligations under a contract to another organisation provided this does not reduce your statutory consumer rights.

You may transfer your rights where the law permits.

We may request reasonable evidence of such a transfer.

46. Third-Party Rights

The contract is between you and Blakmint Ltd.

No other person has a right to enforce these Terms unless applicable law provides otherwise.
